Agreement:
A Firm and binding agreement exist between Absolute Video (hereafter known as “AVP”) and
Client only after agreement has been properly executed and all fees paid at least eight (8) days prior to the event. A eight hundred ($800.00) dollar retainer must be paid at the time of booking, with the balance due at least 8 days prior to the wedding date. The initial retainer is made to secure the date for AVP’s services. It is guaranteed that AVP will schedule video coverage on your wedding day. It is not guaranteed that AVP will videotape your event. Only your second payment (the balance) will guarantee coverage. The retainer is non-refundable. Should you not pay the payment due at least eight (8) days prior to your wedding date, your retainer will be forfeited and AVP will be under no further obligation to you. The agreement is for the exact date. If payment has been paid in full and the date of the wedding is changed, and AVP is still available, you will not be penalized and AVP will shoot on your new date.
Display Rights: It is understood that AVP retains the rights to use your video master. You in signing this agreement are acting as agents for all members of the party and guests and grant AVP all rights for display, airing, and advertising use of all video obtained under this agreement.
Rights: Client warrants that he/she has the legal rights to anything AVP will videotape including photographs, audiotapes, compact discs, music copyright, videotapes, dvds, or any other elements delivered to AVP or requested to use for inclusion in the Client’s video/dvd. Client agrees to indemnify and hold AVP harmless for any loss, damage, or liability for infringement of any rights arising from the use of sale of tapes client hires AVP to produce, edit or duplicate.
Studio Liability and Guarantee: Liability is limited to refund of money paid. AVP takes the utmost care in producing your video project. In the unlikely event that a problem arises whether due to lateness, no show, accident, neglect, human error, loss of materials, acts of god, or equipment or other failures and AVP is unable to provide ANY videotaped coverage, all payments paid will be refunded. This is the extent of AVP’s liability. AVP is not responsible for loss of video or audio quality due to restrictions at the wedding location or interference from surrounding communication devices. AVP reserves the right to substitute videographers. AVP does not guarantee any particular event, interview, or special request. AVP reserves the right to edit all videos/dvds and shall not be obligated to provide the original footage in its entirety. All employees and sub contractors are professionally trained and/or instructed by AVP’s staff. It is understood that Client has hired AVP and not specifically the appearance of Tom Sielatycki.
Production Material: Including photographs, invitation, titles, music, directions, and itinerary are due at least two (2) weeks prior to the wedding date. All materials will be returned to the client upon final payment.
Delivery of Video/DVD: The master videotape(s) and/or dvd(s) will be available approximately 12 weeks after the event and after all production material is provided to AVP. Our team takes great pride in our attention to detail. This is a video/dvd you’ll enjoy for a lifetime. Please allow AVP to produce under our successful time parameters. We cannot accept responsibility for material lost or damaged in transit. Videotapes, DVD’s, and production material (back to client) is delivered via Federal Express unless you make other arrangements in advance. Final edited master and other materials will be shipped promptly upon final payment.
AVP refers to Absolute Video Productions and SlatsVideo, Inc., its lessees, sub-contractors, agents, or servants. By signing this agreement, you certify that you have read this contract and understand your obligations.
